Hofstetter History Software in 3972 Noble-Contrée (VS), Switzerland , built Phersu Atlas (hereinafter simply the "Service" or “Phersu Atlas” or “App”) app as a Commercial app and website https://phersu-atlas.com. This SERVICE is provided by Hofstetter History Software (hereinafter simply the "Company") and is intended for use as is. This page is used to inform visitors regarding my policies with the collection, use, and disclosure of Personal Information if anyone decided to use my Service. If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that the Company collects is used for providing and improving the Service. The Company will not use or share your information with anyone except as described in this Privacy Policy. The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which are accessible at Phersu Atlas unless otherwise defined in this Privacy Policy.


2. Information Collection and Use

For a better experience, while using our Service, The Company may require you to provide us with certain personally identifiable information, including but not limited to Name, Date of Birth, Email. The information that the Company requests will be retained on your device and is not collected by me in any way. The app does use third-party services that may collect information used to identify you.

Personal data is provided directly by the interested party or, in the particular case in which the Website or App is accessed through the login credentials for Facebook, Google, Apple, etc., by such third-party companies. Personal data may be processed for the following purposes:

a) management of registration on the Phersu Atlas Website or App;

b) provision of the search engine service;

c) provision of Premium Content

d) any service communications with the Suppliers in relation to the Premium Content;

e) management of administrative practices and payments, as well as to ensure security, prevent fraud and debugging;

f) selection of basic ads (basic ads), also from third-party partner companies of Phersu Atlas, which can be shown based on the content viewed by the user, the app used, the approximate location, or the type of device;

g) evaluation of the performance of advertisements;

h) evaluation of content performance;

i) product development and improvement;

j) sending by Phersu Atlas promotional communications about discounts, offers, events or services similar to those previously purchased by the interested party, only with the explicit consent of the interested party;

k) sending by Phersu Atlas promotional communications about discounts, offers, events or services other than those previously purchased by the interested party, only with the explicit consent of the interested party;

l) profiling activities, i.e. evaluating the tastes, preferences and consumption habits of the interested party, also through an invitation to participate in market research, and also by combining and combining offline data sources, only with the explicit consent of the interested party;

m) communication of the Data Subject's data to third-party partner companies of Phersu Atlas for the purpose of sending commercial and promotional communications by the aforementioned companies, only with the explicit consent of the Data Subject;

n) offer of promotions through the processing of location data collected, when the App is in use or in the background, through technologies such as GPS, WiFi and Bluetooth, only with the explicit consent of the interested party;

o) sending push notifications directly to the mobile device or tablet, only with the explicit consent of the interested party, who can activate this service during the configuration of the App on their device or tablet. The legal basis for the processing of personal data is the execution of a contract and the provision of the requested service (for the purposes referred to in letters a), b), c), d), e), f), g), h), i) and the consent of the interested party (for the purposes referred to in letters, j), k), l), m), n), o) p).


3. Methods of data treatment

Phersu Atlas informs that: a) for the aforementioned purposes, the data of the interested party will also be processed with IT, telematic, paper and manual tools, in compliance with the rules of confidentiality and security established by law; b) in the event of consent to profiling, it will presuppose an automated activity in order to place the interested party in a category of subjects with homogeneous characteristics on the basis of the services he will have used, the market analyzes in which he will have possibly participated and the its demographic class.


4. Provision of data and consequence of any refusal

The provision of personal data is optional. However, failure to provide personal data for the purposes referred to in point 1 letters a), b), c), d), e), f), g), h) i) may prevent Phersu Atlas from providing the own services to the interested party. Any subsequent objection or withdrawal of consent to the processing of personal data for the aforementioned purposes will also result in the immediate suspension of the use of the related services. Any refusal to consent to the processing for the further purposes referred to in point 1 letters j) k) l) m) n) o) p) will not entail any consequences, except for the impossibility of: being informed about discounts, offers, Phersu Atlas services or events and any initiatives to survey Phersu Atlas customer satisfaction, receive commercial communications of interest from Phersu Atlas and receive promotional communications from partner companies of Phersu Atlas.


5. Data communication

As part of the organization of Phersu Atlas, the data may be processed by the persons in charge of the competent offices for carrying out the individual processing activities (for example Commercial, Marketing, IT). We may share personal data with other partner companies, for example to provide the requested products and services; to manage and improve our products, services and day-to-day operations; to help us personalize your experience; where relevant, to contact and interact with you; and when permitted and appropriate, for marketing and research purposes. We may also share your personal data with an organization to which we sell or transfer (or enter into a sale or data transfer negotiation) any of our assets or any of our rights or obligations under agreements we have with you. The personal data collected for the processing purposes indicated in letters (a) and (b) of point 1 will be kept for the entire duration of the registration of the interested party on the Phersu Atlas site or app, or until the request for data cancellation is transmitted by the user. The personal data collected for the processing purposes indicated in paragraph 1 letters (c), (d), (e), (f), (g), (h) and (i) will be kept for as long as necessary for the provision of the services purchased or requested, and subsequently for a period not exceeding the limitation period established by law. The personal data collected for the processing purposes indicated in letter (e) of paragraph 1 will be kept until the interested party withdraws his consent to the publication of reviews or requests the deletion of his data. The interested party has the right to: a) obtain the cessation of treatment in cases where his personal data are processed for direct marketing purposes, also in relation to services identical to those already provided by our company (so-called right of opposition); b) obtain information in relation to the purposes for which the personal data are processed, the period of processing and the subjects to whom the data are communicated (so-called right of access); c) obtain the correction or integration of inaccurate personal data concerning the interested party (so-called right of rectification); d) obtain the cancellation of personal data concerning the interested party; e) obtain that the personal data concerning the interested party are only kept without any other use being made of them in the following cases (i) the interested party disputes the accuracy of the personal data, for the period necessary to allow us to verify the accuracy of such personal data; (ii) the personal data are necessary for the assessment, exercise or defense of a right in court; (iii) the interested party has opposed the processing and we are awaiting verification regarding the possible prevalence of our legitimate reasons for the processing with respect to those of the interested party (so-called right of limitation); f) receive the personal data concerning the interested party in a commonly used format, readable by an automatic and interoperable device, if they are processed by virtue of a contract or on the basis of your consent (so-called portability right). The interested party also has the right to contact the Guarantor for the protection of personal data, in order to assert his rights in relation to the processing of personal data.


8. Cancellation

The Company, in compliance with the corresponding right of access to the interested party, has set up procedures for which the interested party can request cancellation via an email to info@phersu-atlas.com without unjustified delay of personal data for the following reasons: (i) the data are no longer necessary for the purposes for which they were collected; (ii) the interested party has withdrawn his consent to the processing of data if they are processed on the basis of his consent; (iii) the interested party has opposed the processing of personal data concerning him in the event that they are processed for our legitimate interest; or (iv) the processing of your personal data does not comply with the law.
