1. Introduction
Thank you for choosing Phersu Atlas by Hofstetter History Software which offers a historical atlas consultation service through the use of free or paid content.
By making payment or otherwise using any of the Hofstetter History Software services, including all related functions and features, websites and interfaces, as well as any content and software applications associated with our services (collectively, “Phersu Atlas” or the "Service"), or by accessing any content or material, video or otherwise made available through the Service (the "Content"), you (the "User") enter into a binding agreement with the contracting party Hofstetter History Software (hereinafter simply the "Company"), with registered office in 3972 Noble-Contrée (VS), Switzerland.
The agreement between the Company and the user includes all points of these Terms of Use. The user acknowledges having read, understood and accepted the Terms of Use, and agrees to be bound by them. If the user does not accept them (or does not respect them), he will not be able to use the Phersu Atlas Service or access its Contents.
To use the Phersu Atlas Service and access the Contents, you must (a) be of legal age (subject to the laws of your respective countries); (b) have the ability to enter into a binding contract with the Company and are unrestricted in that respect under any applicable law, and (c) reside in a country where the Service is available. The user further guarantees that all registration information provided to the Company is true, accurate and complete, and agrees to keep it so at all times.
You're not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to the Company.
The Company is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
The Phersu Atlas app stores and processes personal data that you have provided to us, to provide the service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Phersu Atlas app won’t work properly or at all. The app does use third-party services that declare their Terms and Conditions.

You should be aware that there are certain things that the Company will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but the Company cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, the Company cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, the Company cannot accept responsibility.
With respect to the company’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. The Company accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for the both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. The Company does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
2. General information on contents

No responsibility can be attributed to the Company for damages that may arise to users due to any errors and omissions in the contents of the site https://phersu-atlas.com (hereinafter referred to as "the Site") and the App called Phersu Atlas (of hereinafter referred to as "the App").

The Company is not responsible for the contents of the sites mentioned within the pages of its site when written by third parties (comments, posts and similar) and the blogs connected to it and assumes no responsibility for any termination or modification of the activities of the sites in question, indicated for informational purposes only, for any controversy directly or indirectly connected to the contents of the sites and for the damages that may derive.
The contents on the Site and on the App do not represent a newspaper as they are updated without any periodicity. They cannot therefore be considered an editorial product. Some texts or images inserted in the cards are taken from the internet and, therefore, considered to be in the public domain; if their publication violates any copyright, please notify us via email. They will be removed immediately.
The contents present on the Site and on the App are imported from databases owned by the Company and they are owned by the company and cannot be shared. The use of the content is exclusively allowed for personal use. For commercial use an explicit contract of commercial use needs to be agreed with the company.
The data of Phersu Atlas is propriety of Hofstetter History Software. Attributions to external sources are listed as follows:
• This Work includes URLs to Wikipedia.org. Every Information reported is a Wikipedia.org propriety.
• This Work features input data used for the estimates from the World Bank, available under a Creative Commons Attribution-Noncommercial license on their Website (https://www.worldbank.org/).
• This Work features input data used for the estimates from the Maddison Project Database, version 2018. Bolt, Jutta, Robert Inklaar, Herman de Jong and Jan Luiten van Zanden (2018), “Rebasing ‘Maddison’: new income comparisons and the shape of long-run economic development”, Maddison Project Working paper 10, available under a Creative Commons Attribution-Noncommercial license on their Website (https://www.rug.nl/ggdc/historicaldevelopment/maddison/).
Furthermore, some contents present on the App are inserted through APIs (Application Programming Interface), freely provided by other companies. The Company cannot be held responsible for such contents, as well as for the damages that may arise to users due to any errors and omissions, or for any controversy directly or indirectly connected to them, for any violations of copyright and for any damages that may result.
Lastly, the Company is not responsible for sites connected via links within their files, nor for their content, which may be subject to change over time. The buttons present on the Site and the App that refer to external social networks (for example Facebook, Reddit, etc.) allow information to be shared and are governed by the contract conditions and by the information relating to the processing of data by the providers of external services.
3. Summary of the main terms and conditions of sale
These terms and conditions of sale govern the offer and sale of services on the Site and on the Phersu Atlas App made by Hofstetter History Software, with registered office in 3972 Noble-Contrée (VS), Switzerland.
We invite you to read all the Terms of Use carefully before submitting your order, as the following is only a summary of the main terms and conditions of sale.
PERSONS AUTHORIZED TO PURCHASE: only adult consumers can be customers of the Site and the App.
OFFER: The Company offers a service for accessing free content (hereinafter, "Free Content"). The user can also access a series of free or paid contents (hereinafter "Premium Contents").
PRICES: the prices for accessing Premium Content for a fee are indicated in euros and always include VAT.
PURCHASE PROCEDURE: in order to send a purchase order to access the paid Premium Content, you must complete the forms that make up the online procedure (to be considered a contractual proposal). By sending a purchase order to the Company, you declare (a) to have fully read and understood the description of the contents or service (b) to unconditionally accept and undertake to comply with the terms of these Terms of Use.
ORDER MANAGEMENT: once the online procedure has been completed, the purchased Premium Contents are immediately available to the user.
PERSONAL DATA: for any information relating to the processing of personal data, please consult the Privacy Policy section.

4. Scope
Access to paid Premium Contents are offered for sale only to (a) consumers, i.e. any natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out; (b) adults (under the laws of their respective countries); (c) Students and teachers (after sending probative material regarding their personal status such as enrollment in the educational institution or employment relationship with it).
The Company has the right to refuse to process orders from subjects other than those authorized to purchase referred to in points a) and b) and any other order that does not comply with these Terms of Use.
The Company sells on the Website and on the App:
Access to paid Premium Content, i.e.the Basic Licence, the Premium Licence and the Platinum. The content provided by each product is detailed in https://phersu-atlas.com.
4.1. Premium Content Rules
4.1.1. Information and prices
All paid Premium Contents offered by the Company on the Site and on the App contain a detailed description and a price indicated in Euros and inclusive of VAT.
By submitting the purchase order, you declare that you have fully read and understood the description of the selected Premium Content.
4.1.2. Disclaimer
The Company is solely responsible for the sale of services that it has provided in its own name and on its own account.
4.1.3. Payments
Before sending the purchase order, the user is required to provide the information to process his payment through the payment method selected from those available (for example, credit card information).
All financial details (i.e. credit card number or expiry date) are sent via protocol to Stripe or to other payment service providers available from time to time on the Site and App, without third parties having access to the same. These details are not used by the Company except to complete the purchase procedure, to make refunds or to report cases of fraud to the police authorities.
4.1.4. Conclusion of the sale
An order is considered sent when the Company receives the purchase order electronically and the information indicated therein is verified and deemed correct.
The contract is considered concluded when – against an authorized payment through the Site or the App – the Company provides access to the requested Premium Content or the possibility to use the selected Premium Service.
4.1.5. Billing
The Company undertakes to transmit the invoice or payment receipt relating to the sums received directly to the user.
4.2. Applicable provisions
4.2.1. Selling Access to Premium Content
With reference to the paid Premium Contents, upon acceptance of the order and an authorized payment through the App, the Company allows the user to immediately access such contents.
4.2.2. Customer rights and obligations
Users who purchase access to Premium Content may only have such content for entertainment purposes. They accept that they cannot in any way and for any reason use them for commercial purposes, nor disseminate them outside the App and the Site, free of charge and/or for consideration, and that they cannot claim rights to such contents, on which the Company retains ownership.
Changes to This Terms and Conditions
The Company may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. The Company will notify you of any changes by posting the new Terms and Conditions on its webpage in the section “About”.
